1. Introduction
By accessing or using WorkMate you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the platform.
2. Eligibility
- You must be at least 18 years of age to register or transact on WorkMate.
- The platform is intended for use by Irish residents and businesses registered in the Republic of Ireland.
- By registering, you confirm that the information you provide is accurate, current, and complete.
- By creating an account you confirm you meet the age and residency requirements stated above.
3. Account Registration
- You may only hold one account per individual or business entity.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must notify us immediately at legal@workmate.ie if you suspect unauthorised access to your account.
- WorkMate reserves the right to suspend or terminate accounts that breach these terms.
4. Service Listings & Job Posts
- All job descriptions and service listings must be accurate, truthful, and complete.
- You may not post listings for illegal services, services requiring unlicensed practice, or any content that is fraudulent, offensive, or harmful.
- WorkMate reserves the right to remove any listing or job post that violates these terms or our Community Guidelines, without prior notice.
- Customers are responsible for specifying job requirements accurately to enable fair and accurate quoting.
5. Payments
All payments on WorkMate are processed through Stripe Connect. By transacting on the platform you agree to Stripe's Terms of Service in addition to these terms.
- All payments for services booked through WorkMate must be processed through our Stripe-powered payment system. Off-platform payments — including cash, bank transfer, or any other method — are prohibited for any job originating on the platform, regardless of value. Stripe holds payments securely until the job is confirmed complete.
- In the event of a dispute, WorkMate will mediate in good faith. Funds may be held pending resolution.
- All amounts are displayed and charged in Euro (EUR). WorkMate does not accept off-platform cash payments for jobs booked through the marketplace.
- WorkMate is not a financial institution or escrow service. Stripe Technology Europe, Limited — a licensed payment institution authorised by the Central Bank of Ireland — processes and holds all payments.
- Refunds are subject to WorkMate's refund and dispute policy, as detailed in our Happiness Pledge. Our team aims to begin reviewing disputes within 3 business days of submission and reach a final decision within 7 days.
- Payment Release Timeout: If a Customer does not mark a job as complete within 5 days of the Provider marking it complete, WorkMate may automatically release funds to the Provider, subject to no active dispute. Customers should raise any concerns within this 5-day window.

The customer service fee is added to the quote amount at checkout and is shown to the customer before payment confirmation. Rebooking discounts apply when the customer and provider have completed at least one job together on the platform.

Provider commission
Provider commission is deducted from the provider payout based on the provider's active subscription plan. Rates decrease for repeat bookings with the same customer.

6. Provider Obligations
- Providers must hold Verified Prostatus, which requires identity verification via WorkMate's two-layer verification process.
- Providers working with vulnerable adults or children must comply with all applicable legal requirements regarding background checks and disclosures.
- Providers are solely responsible for holding appropriate public liability insurance, trade qualifications, and any licences required to perform their services under Irish law. WorkMate does not provide, arrange, or verify insurance coverage. WorkMate accepts no liability for loss or damage arising from uninsured work.
- Providers are independent contractors — not employees or agents of WorkMate. WorkMate is not liable for the quality, legality, or safety of services performed.
- Identity Verification: WorkMate verifies Providers via Stripe Identity, which confirms a government-issued ID. This does not constitute a criminal background check, vetting, or endorsement of any Provider. Customers are responsible for their own due diligence before hiring.
- Restricted Business Categories: WorkMate reviews every Provider application for business category eligibility. Services in restricted categories — including weapons & firearms, adult sexual services, illegal substances, cannabis-related products, unlicensed financial or medical or legal services, gambling, cryptocurrency exchange, and securities / investment advice — are not permitted on the platform and such applications will be rejected. Providers must disclose their full scope of services honestly; any attempt to misrepresent services to obtain approval is a breach of these Terms and grounds for immediate account termination. The canonical list of restricted categories is maintained in WorkMate's admin reference and may be updated as Stripe's prohibited-business policy evolves.
- Chargeback Liability:WorkMate underwrites chargebacks and refunds to Customers as the merchant of record. Where a chargeback arises from Provider misconduct (undelivered services, fraudulent claims, or breach of platform policy), WorkMate reserves the right to recover the disputed amount plus any Stripe-imposed fines from the Provider via deduction from future payouts, and to suspend or terminate the Provider's account. Providers remain liable to WorkMate for the financial consequences of their own misconduct even where the platform has borne the initial loss.
7. Fees
- WorkMate charges a platform service fee on each completed job, deducted from the provider payout. The applicable fee rate is displayed during the quoting and checkout process.
- Subscriptions. Providers may subscribe to a paid subscription tier (WorkMate Pro or Premium) for enhanced visibility, lower commission, and additional platform features. All subscriptions are month-to-month with no lock-in and no free trial — you are charged on the day you subscribe. You may cancel at any time; your plan remains active until the end of the current billing period, and your listings, reviews, and payout history are preserved after downgrade to the free Starter tier.
- Goodwill refund window. As a one-time-per-account goodwill measure, WorkMate offers a ten (10) day refund window from the date of your first successful subscription charge. A refund request within this window is reviewed and typically processed within two (2) business days. Refunds may be declined where (a) a prior refund has been issued on your account, (b) a payment dispute or chargeback has been initiated, or (c) your account is under fraud or terms-of-service review. Where granted, the refund is the full fee of the most recent paid period, returned to your original payment method within ten business days. Outside this window, subscription fees are non-refundable except where required by applicable law or at WorkMate's sole discretion (for example, platform fault or outage).
- Trader status. You subscribe to a Pro or Premium plan in your capacity as a trader operating a business in the Republic of Ireland — not as a consumer. The fourteen-day right of withdrawal for distance contracts under Directive 2011/83/EU (Article 9) and the equivalent provisions of the Irish Consumer Rights Act 2022 therefore do not apply to your subscription purchase.
- Changes to subscription fees, commission rates, or subscription terms will be communicated by email with at least fifteen (15) days' advance notice, in compliance with Regulation (EU) 2019/1150 (Platform-to-Business) Article 3(2). If you do not agree to a change, you may cancel before the effective date without penalty.
- Disputes and chargebacks. Please contact WorkMate support at support@workmate.ie before initiating a payment dispute with your card issuer. This request does not waive your rights under the Revised Payment Services Directive (PSD2) or applicable card-scheme rules (Visa, Mastercard), but gives us an opportunity to resolve the issue directly. Disputes filed without prior contact may be contested by WorkMate with submission of this clause and our internal support record as evidence.
- WorkMate reserves the right to update its fee structure and platform policies with at least fifteen (15) days' advance notice to affected users, as required by Regulation (EU) 2019/1150.
8. Prohibited Conduct
The following conduct is strictly prohibited on WorkMate:
- Fraud, impersonation, or misrepresentation of identity or qualifications.
- Harassment, abuse, discrimination, or threatening behaviour toward any user.
- Posting, soliciting, or submitting fake reviews or ratings.
- Circumventing platform payments by arranging off-platform transactions for jobs introduced through WorkMate.
- Scraping, automated access, or reverse engineering of the platform.
- Any activity that violates applicable Irish, EU, or international law.
Violation of these prohibitions may result in immediate account suspension, removal of funds, and referral to law enforcement authorities.
9. Limitation of Liability
WorkMate operates as a marketplace intermediary and is not the employer, principal, or agent of any service provider. To the maximum extent permitted by Irish law:
- WorkMate is not liable for any damage, injury, loss, or expense arising from services performed by providers found through the platform.
- Our total aggregate liability to you for any claim arising from or relating to these terms or your use of the platform shall not exceed the total fees paid by you to WorkMate in the 12 months preceding the claim.
- Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
10. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Ireland. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Irish courts.
11. Changes to These Terms
WorkMate may update these Terms & Conditions from time to time. We will provide at least 30 days' written notice of any material changes via the email address registered to your account. Continued use of the platform after the effective date of changes constitutes acceptance of the revised terms.
12. Intellectual Property
- All platform content, logos, and branding are owned by WorkMate and protected under Irish and EU intellectual property law.
- Users retain ownership of content they submit (job descriptions, reviews, portfolio photos).
- By posting content on WorkMate, you grant us a non-exclusive, royalty-free licence to display, reproduce, and distribute that content on the platform for the purpose of operating the marketplace.
- Users must not upload or submit content that infringes third-party intellectual property rights.
AI-Generated Content
- WorkMate uses AI to suggest job descriptions and improve listing quality. These are suggestions only — you are responsible for reviewing and approving all content before posting.
- AI-generated text is not legal, professional, or trade advice. It does not replace your obligation to describe jobs accurately.
- No personal data is included in AI requests. Job description text is processed by our AI provider (Groq) and is not stored after processing.
- Use of the AI feature is optional and does not affect your ability to post jobs manually.
DAC7 Tax Reporting
WorkMate is required under EU DAC7 regulations (Directive 2021/514, transposed into Irish law) to report seller earnings to the Irish Revenue Commissioners annually.
- Providers earning over €2,000/year or completing 30+ transactions must provide valid tax information (name, address, tax identification number, date of birth).
- Data reported includes: name, address, tax ID, bank account details, total earnings, and transaction count.
- Revenue Commissioners may share this information with tax authorities in other EU member states.
- WorkMate cannot process Provider payments without the required tax information.
13. Indemnification
- You agree to indemnify and hold harmless WorkMate, its owner, employees, and agents against any claims, losses, or damages arising from your use of the platform or breach of these terms.
- This includes claims from third parties related to user-generated content or services you provide or receive through WorkMate.
- WorkMate will notify you promptly of any such claim and cooperate reasonably in its defence.
14. Force Majeure
Neither party shall be liable for failure to perform obligations under these terms where such failure results from circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, government actions, or internet outages. The affected party must notify the other as soon as reasonably practicable.
15. Dispute Resolution
WorkMate's Happiness Pledge governs our dispute resolution process for completed jobs, including the 14-day dispute window, available remedies (full refund, partial refund, or mediation), and our commitment to begin review within 3 business days and issue a final decision within 7 days.
- Users should first contact support@workmate.ie to attempt to resolve disputes informally.
- If a dispute cannot be resolved within 30 days, either party may refer the matter to mediation.
- Mediation shall be conducted under the rules of the Mediators' Institute of Ireland.
- Nothing in this clause prevents either party from seeking urgent injunctive relief from the Irish courts.
- You may also refer consumer disputes to the EU Online Dispute Resolution platform. This link is provided in accordance with Regulation (EU) 524/2013.
16. Severability
If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
17. Consumer Rights (CRA 2022)
Under the Consumer Rights Act 2022 (which implements EU Directive 2019/771 and Directive 2019/770 into Irish law), you have the following rights when booking services through WorkMate:
- Right to cancel (14 days): Where you book a service from a trader (Verified Pro provider) on WorkMate, you have a statutory right to cancel the contract within 14 calendar days of accepting a quote, without giving any reason, provided the service has not yet commenced. Cancellations within this 14-day period are penalty-free under the Consumer Rights Act 2022. To exercise this right, contact support@workmate.ie before the cancellation deadline.
- Late cancellation fee: If you cancel a job after the 14-day statutory cancellation period has elapsed and the provider has already accepted, a cancellation fee of 10% of the agreed quote amount (excluding the WorkMate service fee) may be charged to compensate the provider for lost opportunity. This fee does not apply if work has not yet been scheduled or if both parties agree to cancel by mutual consent.
- Waiver of cancellation right: If you request that service work begins within the 14-day cancellation period, you acknowledge that by accepting a quote you consent to early commencement and that your right to cancel is extinguished once the service is fully performed. If the service is not fully performed within the period, you retain a proportionate refund right for unperformed work.
- Quality and conformity: Services must be provided with reasonable care and skill, within a reasonable time, and in conformity with any description given on the platform. If a service is not performed in conformity with the contract, you are entitled to request a repeat performance or, where repeat performance is impossible, a price reduction or full refund.
- Complaint escalation: If your complaint is not resolved within 30 days, you may refer your case to the Competition and Consumer Protection Commission (CCPC) at www.ccpc.ie.

18. Digital Services Act (DSA)
WorkMate is an online platform within the meaning of Regulation (EU) 2022/2065 (the Digital Services Act). As an intermediary service, WorkMate facilitates connections between customers and independent service providers but does not itself provide, endorse, or guarantee the services listed on the platform.
- Reporting illegal content: If you encounter content on WorkMate that you believe is illegal, you may report it by emailing legal@workmate.ie with a description of the content and the reason you consider it illegal. We will acknowledge your report and act on it without undue delay.
- Content moderation: Our content moderation policies are set out in our Community Guidelines. When content is removed or an account is restricted, we will provide a clear statement of reasons to the affected user.
- Appeals: If your content is removed or your account is restricted, you may appeal the decision within 6 months by contacting legal@workmate.ie. Appeals are reviewed by a person not involved in the original decision, and you will be notified of the outcome without undue delay.
